This document sets out the general
terms and conditions of sale on the website www.gant.pl
(hereinafter referred to as the “E-Shop”), owned and operated by Gant Polska
Sp. z o.o., with its registered office in Warsaw (00-120 Warsaw), ul. Złota 59,
VAT ID: 5272725346, REGON: 360192638, registered in the register of
entrepreneurs maintained by the District Court for the capital city of Warsaw
in Warsaw, XII Commercial Division, under KRS number 0000530331, with a share
capital of PLN 8,325,000.00; e-mail: info@pl.gant.com,
(hereinafter referred to as “Gant”).
Article 1 – Definitions
Unless otherwise specified, capitalized terms used in these Terms and
Conditions have the meanings assigned to them herein.
- Gant – Gant Polska Sp. z o.o., with its registered
office in Warsaw (00-120 Warsaw), ul. Złota 59, VAT ID: 5272725346, REGON:
360192638, registered in the register of entrepreneurs maintained by the
District Court for the capital city of Warsaw in Warsaw, XII Commercial
Division, under KRS number 0000530331, with a share capital of PLN
8,325,000.00.
- Business Days – weekdays from Monday to Friday,
excluding statutory public holidays in Poland.
- Delivery – the act of delivering the Goods to the
Client by Gant, in accordance with the delivery method chosen by the
Client.
- Delivery Service – an entity providing delivery
services cooperating with Gant. The current list of Delivery Services is
available on the E-Shop website.
- Password – an individual sequence of letters,
numbers, or other characters set by the Client during Registration to
secure access to the Client Account.
- Client – a natural person, legal entity, or
organizational unit with legal capacity, using the E-Shop, including
entering into a Sales Agreement or using electronic services. A natural
person must be at least 18 years old.
- Consumer – a natural person performing a legal act
with an entrepreneur not directly related to their business or
professional activity, as referred to in Article 221 of the Civil Code.
- Entrepreneur – a natural person, legal entity, or
organizational unit conducting business or professional activity on their
own behalf.
- Client Account – an individual account created in
the E-Shop for the Client, enabling the use of the E-Shop functionalities,
including placing orders and managing data.
- Login – the Client's e-mail address used as an
identifier when logging into the Client Account.
- Registration – the process of creating a Client
Account in the E-Shop, requiring the provision of personal data and
acceptance of the Terms and Conditions and Privacy Policy.
- Gant Store – a stationary sales point operated by
Gant. The list of Gant Stores is available on the E-Shop under “List of
Gant Stores.”
- Goods – products offered by Gant through the
E-Shop, which may be the subject of a Sales Agreement. Only original
products are offered for sale.
- Sales Agreement – a distance contract between the
Client and Gant regarding the purchase of Goods under the terms set out in
the Terms and Conditions.
- InPost Parcel Locker – devices or points allowing
self-delivery and collection of shipments, in accordance with the rules of
the logistics operators.
- Electronic Services – services provided by Gant
electronically, including management of the Client Account, Newsletter,
Contact Form, and Push service.
- Newsletter – a service involving sending commercial
information to the Client electronically, in accordance with the rules set
out in the Terms and Conditions.
- Push – a service involving presenting individual
product proposals to the Client, particularly via browser notifications or
within the E-Shop.
Article 2 – Operation of the E-Shop
- These Terms and Conditions set out the rules for
concluding a Sales Agreement via the E-Shop at www.gant.pl. Orders are placed and accepted
exclusively via this website.
- Gant has the exclusive right to operate the E-Shop.
- All rights to the E-Shop, including its name,
domain, design, and general appearance, as well as all types of
information, images, the Gant brand, and other brands offered in the
E-Shop, including property copyrights and other intellectual property
rights, belong to Gant. Materials used in the E-Shop, including code or
software, may not be modified, copied, reproduced, published, installed on
another computer, sent by mail, transmitted, displayed, or distributed
without prior consent from Gant or without disclosing their source. These
rights may be used only as permitted and in accordance with the Terms and
Conditions.
- Use of the E-Shop is possible provided that the
Client’s IT system meets the following minimum technical requirements:
a) a web browser supporting JavaScript: Internet Explorer (version 8.0 or higher), Mozilla Firefox (version 22 or higher), or Google Chrome (version 27 or higher),
b) a minimum screen resolution of 1024 x 768 pixels,
c) an e-mail account and Internet access. - Images and visualizations of Goods presented in the
E-Shop are for illustrative purposes only and may not reflect the actual
size, color, or proportions of the products.
- Contact with the E-Shop is available 24/7 via
e-mail (info@gant.pl) or on Business
Days via phone (+48 947 213 892) from 8:00 a.m. to 4:00 p.m. Clients may
contact the E-Shop via e-mail or the contact form at www.gant.pl/kontakt.
- Orders in the E-Shop may be placed:
a) after Registration and creating a Client Account (“Purchases with Registration”), or
b) without Registration, by providing data necessary to process the order (“Purchases without Registration”).
Browsing the E-Shop does not require Registration. - Clients are prohibited from posting illegal content
and using the E-Shop or electronic services in a manner contrary to the
law, good practice, or infringing third-party rights.
- Information posted in the E-Shop does not
constitute an offer by Gant under the Civil Code but an invitation to
Clients to make offers to conclude a Sales Agreement.
- By placing an order, the Client declares that they
are of legal age and fully capable of legal acts (including entering into
contracts).
- Individuals registering or making purchases in the
E-Shop provide their personal data and consent to their processing by Gant
in accordance with the Privacy Policy. To verify the data provided during
Registration, the Client receives an e-mail requesting confirmation.
Article 3 – Client Account
- A Client may create their own Client Account. Each
Client is entitled to hold a maximum of one Client Account at the same
time. Gant reserves the right to remove multiple registrations.
Registration enables the Client to:
- enter, edit, or delete data, including delivery
addresses;
- place orders using the data provided by the
Client;
- create shopping lists;
- view order history;
- subscribe to and unsubscribe from the Newsletter;
- use discount codes;
- make payments for orders upon delivery;
- use other functionalities made available to
registered Clients.
- To register, the Client must:
a) read and accept the Terms and Conditions and Privacy Policy,
b) provide personal data, including first name, last name, e-mail address, Password, and other required information,
c) give consent to the processing of personal data by Gant,
d) complete and submit the registration form available in the E-Shop by selecting the appropriate checkbox. - After submitting the complete registration form, a
link for account activation will be sent to the Client’s e-mail address
provided in the registration form. By clicking the activation link, the
Client will be redirected to the E-Shop login page. At this moment, an
agreement is concluded for the provision of electronic services related to
managing the Client Account. This grants the Client access to the Client
Account and the right to modify the data provided during Registration,
except for the Login.
- The Client Account created through registration is
maintained indefinitely. The Client may resign from maintaining the
account and request its deletion at any time. No fees are charged for
account resignation or deletion.
- During Registration, the Client may voluntarily
consent to the processing of their personal data for marketing purposes by
selecting the appropriate checkbox in the registration form. In such
cases, Gant will indicate the purpose of collecting the Client’s personal
data and known or anticipated recipients of such data.
- Consent to the processing of personal data for
marketing purposes is not a condition for concluding an agreement with
Gant for the provision of electronic services for managing the Client
Account. Consent may be withdrawn at any time by submitting an appropriate
statement to Gant via e-mail at gdpr@gant.pl.
- To delete a Client Account from the E-Shop, the
Client should contact Gant by phone (+48 947 273 892) from 8:00 a.m. to
4:00 p.m. The request will be processed after confirming that the
requester is the account holder. Account deletion will occur within 14
days of the request and constitutes termination of the agreement for the
provision of electronic services related to the Client Account.
- Gant may block a Client Account in cases provided
for by applicable law. Gant may also block a Client Account for important
reasons, including:
- violation by the Client of applicable laws,
third-party rights (including intellectual property rights), personal
rights of third parties, or social norms while using the E-Shop;
- repeated (at least twice) violation by the Client
of the Terms and Conditions;
- repeated (at least twice) submission of orders
with incorrect address details preventing delivery;
- persistent and repeated withdrawal from the
agreement under § 9 of these Terms and Conditions, if withdrawal is not
justified by the impossibility of Gant fulfilling the order.
- The Client will be notified via the e-mail address
registered in the E-Shop of the intent to block the account. Blocking the
account under the preceding paragraph constitutes immediate termination of
the agreement for electronic services.
- In the event of account blocking as described in
sections 8–9, any unfulfilled orders from the Client will be canceled by
Gant within 1 day. If payment has already been made, Gant will refund the
full amount in accordance with applicable law.
Article 4 – Placing Orders
- Clients may place orders 24 hours a day, 7 days a
week.
- Placing an order constitutes an offer to conclude a
Sales Agreement for the Goods specified in the order, in accordance with
the Civil Code.
- For Purchases with Registration, the Client places
an order after logging into the E-Shop by adding Goods to the cart,
selecting the payment and delivery method, and providing data required for
order fulfillment, including VAT invoice details (if requested). The
Client may also add delivery instructions. For delivery to an InPost
Parcel Locker, the Client must provide a mobile phone number or e-mail
address to receive notification of delivery availability.
- For Purchases without Registration, the Client
places an order by adding Goods to the cart, selecting “Order,” and
providing payment, delivery, and personal details required to process the
order, such as: first name, last name, date of birth, gender, phone
number, address, e-mail, and VAT invoice details (if requested). The
Client must accept the Terms and Conditions and consent to the processing
of personal data. For InPost Parcel Locker delivery, the Client must
provide a mobile phone number or e-mail address.
- The ordering process concludes when the Client
selects the “Confirm Order and Pay” option. This action confirms the order
placement.
- After placing the order, the Client will receive
via e-mail:
a) confirmation that the order has been received by Gant,
b) a link to the current Terms and Conditions,
c) an individual order number (“Order Code”) to track the order status.
Confirmation of receipt does not constitute acceptance of the order by Gant. - After processing the order, the Client will receive
an SMS with confirmation of acceptance and shipment details (“Shipping
Confirmation”). At the moment of receiving the Shipping Confirmation, the
Sales Agreement is concluded. The agreement is effective for the duration
of order fulfillment. The place of performance is the delivery address
provided by the Client.
- The Client must make payment immediately after
placing the order. Failure to pay will result in the order not being
recognized as valid, and the Sales Agreement will not be concluded. The
Client may attempt to place the order again.
- The Client may choose from the currently available
payment methods listed in the E-Shop under “Payment Methods,” including:
a) PayU service, - Gant reserves the right to restrict delivery
methods and payment options for Clients with more than two pending orders
awaiting pickup at an InPost Parcel Locker or with a courier.
- Both for Purchases with and without Registration,
after concluding the Sales Agreement, Gant confirms the terms of the
agreement by sending them to the Client’s e-mail provided during
Registration or order placement.
- At any stage of the order process, before payment
is made, the order may be canceled by the Client by discontinuing the
checkout process. Orders not completed by the Client will not be
processed.
- The Client’s order is registered and stored in the
Gant system. Accounting documents confirming the Sales Agreement are
retained for 5 years.
- Gant may contact the Client via e-mail or phone to
clarify doubts, confirm the order, or address other issues related to
order fulfillment.
Article 5 – Payments
- All prices of Goods available in the E-Shop are
listed in PLN and include VAT. Prices do not include additional costs,
such as delivery fees, which are indicated to the Client before placing
the order.
- The price of each item is valid at the moment the
order is placed.
- The Client may make payment using one of the
currently available methods listed in the E-Shop under “Payment Methods,”
which may include, among others, fast electronic payments (PayU), card
payments, and bank transfers.
- For Purchases without Registration, payment may
only be made prior to receipt of the Goods. The order will be processed
after Gant receives confirmation of successful payment from the payment
provider.
- Payments are processed by certified operators in
accordance with applicable security standards.
- Clicking the “Confirm Order and Pay” button
constitutes placing an order with an obligation to pay, in accordance with
Article 17 of the Consumer Rights Act.
- Gant reserves the right to change the prices of
Goods, introduce or cancel promotions, introduce new Goods, and make
changes to the assortment. All orders placed before such changes are
introduced will be fulfilled under the original terms.
- Promotions in the E-Shop cannot be combined unless
the promotion rules state otherwise.
- Clients making Purchases with Registration may use
discount codes if active and compliant with the promotion terms. Discount
codes cannot be combined with other promotions unless stated otherwise in
the promotion rules.
Article 6 –
Order Fulfillment and Delivery Dates
- Order fulfillment occurs after Gant receives
payment confirmation. The Client may choose one of the available delivery
methods listed on the E-Shop website, in particular:
a) delivery to the address provided by the Client in the registration form (Purchases with Registration) or provided during order placement (Purchases without Registration),
b) InPost Parcel Locker within the territory of the Republic of Poland.
The Client is informed on the website pl.gant.com about the available delivery options for Goods. - Deliveries are carried out exclusively within the
territory of the Republic of Poland.
- Goods offered in the E-Shop are in stock unless
stated otherwise.
- In exceptional situations, e.g., when multiple
Clients order the same item simultaneously, the Goods may become
unavailable. In such cases, the Client will be informed that the order
cannot be fulfilled, and the Sales Agreement will not be concluded. Gant
will refund all payments received from the Client in accordance with the
law.
- If an order cannot be fulfilled for other reasons,
the Client will be informed via e-mail or phone. The Sales Agreement will
not be concluded, and payments made will be refunded.
- In the event of stock unavailability or inability
to fulfill the order for other reasons (e.g., simultaneous orders), the
Client will be notified via e-mail or phone about the issue and possible
solutions. If it turns out the order cannot be fulfilled, the Sales
Agreement will not be concluded. Gant will refund all payments according
to applicable law.
- Goods are delivered free of defects, in accordance
with the Civil Code provisions on warranties.
- Order fulfillment begins according to the rules
specified in Article 5.
- The delivery period is 2 to 4 business days from
the moment the Shipping Confirmation is sent. This period constitutes an
essential element of the Sales Agreement.
- The Client is obliged to provide a correct and
current delivery address and contact phone number. Gant is not responsible
for delays or non-delivery due to incorrect data, provided that due
diligence was exercised.
- On the day of shipment, the Client will receive an
e-mail with shipment information.
- The Client should inspect the shipment in the
presence of the delivery service. In case of damage or missing items, the
Client has the right to request a damage report.
- Each shipment includes a receipt. Upon the Client’s
request, a VAT invoice will be issued after providing the necessary data.
- Delivery costs are borne by Gant.
- The Client receives e-mail notifications regarding
order status, including reminders about incomplete orders and thank-you
messages after order completion.
- For delivery to an InPost Parcel Locker, the Client
has 2 days to collect the shipment. After this period, the shipment may be
returned to the sender, and the order will be canceled.
Article 7 –
Warranty (Rękojmia)
- Gant is liable to the Client if the sold Goods have
a physical or legal defect (warranty), in accordance with the Civil Code.
- Goods have a physical defect if they do not conform
to the agreement, in particular if:
a) they lack the properties that goods of that type should have,
b) they do not match the description or sample,
c) they were delivered in an incomplete condition. - A Client who discovers a defect in the Goods may:
a) request a price reduction,
b) withdraw from the agreement (if the defect is significant),
c) request a replacement of the defective Goods,
d) request repair of the defect. - Gant may refuse to fulfill the Client’s request if
bringing the Goods into conformity with the agreement in the manner chosen
by the Client is impossible or would incur excessive costs.
- A Consumer Client may rely on the presumption of a
defect – if a defect appears within one year of delivery, it is presumed
to have existed at the time of delivery.
- Gant is liable under the warranty if the defect is
discovered within 2 years from the date of delivery of the Goods.
- A Client exercising warranty rights is obliged to
deliver the defective Goods to Gant’s address. For Consumers, the delivery
cost is borne by Gant.
- Complaints will be reviewed within 14 days of
receipt. Failure to respond within this period is considered acceptance of
the complaint.
- If the complaint is accepted, Gant will refund the
Client for all costs, including delivery and return shipping, provided the
return was made in accordance with the procedure outlined in the Terms and
Conditions.
- Refunds will be made using the same payment method
used by the Client unless the Client agrees to an alternative method
without additional costs.
- The Client has the right to use out-of-court
complaint resolution mechanisms, including Consumer Ombudsman assistance
or the ODR platform: https://ec.europa.eu/consumers/odr
Article 8 –
Complaint Procedure
- Any complaints regarding Goods, order processing,
or issues with return shipments must be submitted:
a) electronically to: info@pl.gant.com,
b) in writing to: E-Shop Gant Polska Sp. z o.o., ul. Muszkieterów 15C C1–C2, 02-273 Warsaw. - The complaint should include: Client contact
information, order number, description of the defect or issue, and the
Client’s request (e.g., replacement, repair, refund).
- Gant confirms receipt of complaints electronically.
- If necessary, Gant may request the Client to return
the Goods for assessment. Return shipping costs are borne by Gant if the
complaint is justified.
- If Goods need to be returned, the Client may:
a) send the Goods independently to the address above,
b) use the free courier pickup service after contacting Customer Service (+48 947 213 892). - Gant does not accept complaints submitted in Gant
Stores.
- Complaints will be resolved within 14 days of
receipt. Failure to respond within this period is considered acceptance.
- Complaints may also be submitted regarding free
electronic services provided by Gant. In such cases, the complaint should
be sent electronically to info@pl.gant.com
and should describe the issue. A response will be provided promptly, but
no later than 14 days.
Article 9 –
Right of Withdrawal
A. Statutory
Right of Withdrawal
- A Consumer Client has the right to withdraw from a
remote Sales Agreement without giving a reason within 30 days from the day
of receipt of the Goods by the Client or a third party indicated by them,
other than the delivery service. Gant voluntarily extends the statutory
withdrawal period to 30 days.
- To exercise the right of withdrawal, the Client
should submit a clear statement of withdrawal to Gant (e.g., letter or
e-mail). The Client may use the withdrawal form attached to these Terms,
but it is not mandatory.
- The deadline is considered met if the statement is
sent before its expiration.
- In case of withdrawal, Gant will refund all
payments received from the Client immediately, and no later than 14 days
from the day of receiving the withdrawal statement.
- Refunds will be made using the same payment method
used by the Client unless the Client explicitly agrees to a different
method without additional costs.
- Gant may withhold the refund until the Goods are
received.
- The Client must return the Goods to Gant
immediately, but no later than 14 days from informing Gant about the
withdrawal. The deadline is met if the Goods are sent before the 14-day
period expires. Returns should be sent to:
E-Shop Gant Polska Sp. z o.o., ul. Muszkieterów 15C hall C1–C2, 02-273 Warsaw. - The Client bears the direct costs of returning the
Goods unless Gant has explicitly agreed to cover them.
- The Client is responsible only for any diminished
value of the Goods resulting from handling beyond what is necessary to
establish their nature, properties, and functionality.
- The right of withdrawal does not apply to
agreements:
a) for services if Gant has fully performed the service with the Client’s consent and the Client was informed that withdrawal rights are lost after performance,
b) for non-prefabricated Goods made to Client specifications or for personalized needs,
c) for Goods delivered in sealed packaging that cannot be returned for health or hygiene reasons if opened,
d) for audio or visual recordings or computer programs in sealed packaging if opened,
e) for delivery of digital content not on a tangible medium if performance started with the Client’s consent before the withdrawal period expired, after being informed of the loss of withdrawal rights. - Returns can be made by the Client:
a) independently, at their own risk, with shipping costs borne by the Client,
b) using the “Quick Returns” service provided by InPost Sp. z o.o., Krakow.
B. Contractual Right of Withdrawal – Returns
1.
Returns are only processed within the territory of the Republic of
Poland.
2.
In addition to the statutory right, Gant grants Clients (both
Consumers and other purchasers) a contractual right of withdrawal within 14
days from the day Gant sends the Shipping Confirmation.
3.
To exercise this right, the Client may submit a withdrawal form
electronically via the E-Shop or use the paper form included with the shipment.
In both cases, the form must be included with the returned Goods:

This contractual right applies only to Goods returned in an
undamaged and complete state, without signs of use beyond what is necessary to
determine the nature, properties, and functionality. Gant reserves the right to
refuse returns outside the deadline or for damaged/incomplete Goods.
5.
The Client may use the “Quick Returns” service provided by InPost
Sp. z o.o., Krakow.
6.
Upon successful withdrawal, Gant will refund all payments using
the same payment method, unless the Client agrees to an alternative without
cost.
7.
Refunds will be made without undue delay, but no later than 14
days from receipt of the returned Goods by Gant.
8.
Before refunding, Gant reserves the right to verify the returned
Goods and may refuse acceptance if inconsistencies are found, notifying the
Client electronically.
9.
If the Client sends non-returnable Goods (e.g., after rejected
complaints or items not purchased from Gant), Gant will notify the Client by
e-mail about the possibility of collection within 30 days. The period may be
extended upon Client request if approved by Gant.
10. After the
deadline expires without collection, Gant reserves the right to:
a) dispose of the items,
b) donate to charity,
c) commercially dispose of (e.g., unusable clothing),
d) treat the items as abandoned and remove them at the Client’s expense
Article 10 –
Free Electronic Services
- Gant provides the following free electronic
services 24 hours a day, 7 days a week:
a) Newsletter;
b) Client Account as described in Article 3 of the Terms and Conditions;
c) Contact Form;
d) Push notifications (individual product suggestions). - Gant reserves the right to select and change the
form, type, method, and access time of selected services. The Client will
be informed of any changes in accordance with the Terms and Conditions.
- The Newsletter service consists of sending e-mails
or SMS messages to the Client with commercial information about new
products, services, and Gant offers. Only Clients who have consented and
subscribed will receive the Newsletter.
- Newsletter subscription can occur:
a) during Client Account registration by checking the appropriate box. - Subscription to the Newsletter is voluntary and
free of charge. The Newsletter service is provided for an indefinite
period. The Client may unsubscribe at any time. To unsubscribe, the Client
may click the link provided in the Newsletter e-mail or use the
appropriate option in their Client Account.
- The Newsletter includes, in particular, the
sender’s identification, the message subject indicating its content, and
information on how to unsubscribe.
- The Contact Form service allows the Client to send
messages to Gant via the form available in the E-Shop.
- Use of the Contact Form is voluntary and one-time.
The Client may discontinue correspondence at any time by notifying Gant.
- The Push service provides individual product
suggestions to the Client (e.g., via browser notifications or the E-Shop),
based on their previous purchases, website activity, profile data, and
declared interests and preferences.
a) If the Client does not wish to receive individual suggestions by e-mail, they may unsubscribe at any time by clicking the link in the message or contacting Gant in any form (e.g., e-mail).
b) If the Client does not wish to use the Push service, they may submit a request to unsubscribe via e-mail at info@pl.gant.com or by mail to Gant’s registered office. The request will be processed without undue delay. - If the Client acts to the detriment of Gant or
other Clients, violates the law, or breaches the Terms and Conditions,
Gant may block access to free electronic services. The block will remain
in effect for the time necessary to resolve the matter. Gant will inform
the Client of the service block via e-mail sent to the address provided
during registration.
Article 11 –
Client Responsibility
- Content posted by the Client while using electronic
services does not reflect Gant’s views and cannot be associated with its
operations. Gant only provides the IT resources and is not the provider of
such content.
- The Client declares that:
a) they hold all rights to the content they publish, including copyright, industrial property rights (e.g., trademarks), and related rights;
b) personal data, likenesses, and information about third parties have been provided legally, voluntarily, and with the consent of the individuals concerned;
c) they consent to the access of posted content by other Clients and Gant, and authorize Gant to use this content free of charge in accordance with the Terms and Conditions;
d) they consent to adaptations of works within the meaning of the Copyright and Related Rights Act. - With regard to the electronic services described in
Article 10, the Client is not authorized to post:
a) personal data of third parties or share images of third parties without legally obtained prior consent;
b) advertisements and/or promotional content. - Gant does not continuously monitor the content
posted by Clients.
- If the Client, a third party, or any other entity
considers that content posted in the E-Shop violates their rights,
personal rights, good manners, morality, beliefs, fair competition,
know-how, trade secrets, or other legal obligations, they should promptly
inform Gant.
- Upon receiving such notice, Gant will take
appropriate action, including possibly removing or blocking access to the
disputed content.
- While using electronic services described in
Article 10, the Client may not post content that, in particular:
a) is offensive or threatens others, contains language violating good manners (e.g., vulgarities or terms commonly considered offensive);
b) violates any third-party rights, including copyrights, related rights, industrial property rights, trade secrets, or confidentiality obligations;
c) is posted in bad faith;
d) conflicts with Gant’s interests or otherwise violates the Terms, good practices, applicable laws, or social norms. - If Gant receives notification that content violates
rights, personal rights, good practices, morality, beliefs, fair
competition, know-how, legally protected secrets, or obligations, Gant
reserves the right to modify or remove the content posted by Clients while
using the electronic services described in Article 10.
- The Client grants Gant a non-exclusive, free
license to use content posted in the E-Shop to the extent necessary for
display, publication, copying, modification, and dissemination within the
E-Shop.
Article 12 –
Final Provisions
- Gant is liable for non-performance or improper
performance of the Sales Agreement and electronic service agreements
described in Article 10. For Clients who are entrepreneurs (i.e., natural
persons, legal persons, or organizational units with legal capacity
conducting business or professional activity), Gant’s liability is limited
to intentional damages and covers only actual losses.
- The Terms may be recorded by printing, saving on a
medium, or downloaded at any time from the E-Shop website.
- In the event of a dispute related to the Sales
Agreement or electronic service agreement, the parties will seek an
amicable resolution. Matters not regulated herein are governed by Polish
law.
- Gant reserves the right to amend these Terms.
Clients will be informed of changes via a notice on the E-Shop website.
Clients with a Client Account will additionally be notified upon their
first login after the new Terms come into effect. Failure to accept the
new Terms constitutes termination of the electronic service agreement.
- The Sales Agreement and electronic service
agreements referred to in Article 10 are concluded in Polish.
- Gant informs Consumer Clients about the possibility
of using out-of-court complaint and claim resolution. Detailed information
is available at offices and websites of entities authorized to resolve
disputes out of court, in particular consumer protection offices and
Provincial Trade Inspection authorities. A list is available on the Office
of Competition and Consumer Protection website: www.uokik.gov.pl.
- Gant also informs Clients of the possibility to use
the online dispute resolution platform (ODR), available at: http://ec.europa.eu/consumers/odr.
- The Privacy Policy is an integral part of these
Terms and Conditions.
- These Terms and Conditions come into force on
15.10.2025.
